Rules and Regulations


DEFINITIONS:

“CITY” shall mean the City of Sealy, Texas.

“LIEDERTAFEL HALL” shall mean the building and grounds of the facility at 116 Lux Rd., Sealy, Texas.

“RENTAL AGREEMENT” means the written permit issued to an applicant by the CITY for the use of the Liedertafel Hall.

“LESSEE” means the renter that is granted a rental agreement to use the Liedertafel Hall.

RIGHT TO ALTER REGULATIONS AND RENTAL RATES: The City reserves the right to change, alter, amend or cancel any or all of the regulations and rental rates contained herein at any time.

AUTHORITY: The City reserves the right for any of its employees to enter the facility at anytime, and to close down the facility any time the LESSEE is found to be in violation of these rules and regulations. The City also reserves the right to increase the amount of the deposit or to refuse to rent the facility to anyone who has violated the rules or caused damage to the facility.

RESERVATIONS: Reserving the Liedertafel Hall may be done between the hours of 8:00 a.m. and 5:00 p.m., Monday through Friday (taking into account scheduled holidays), by contacting the City of Sealy at:

The Liedertafel Hall will be rented on a “first come, first served” basis. Reservation of the Liedertafel Hall may be made up to twelve (12) months in advance of date. A reservation for the Liedertafel Hall will be considered confirmed only upon receipt of a signed rental agreement and full payment of the prescribed damage deposit and base rent.

CANCELLATIONS: A full refund will be made if the Lessee cancels a reservation at least thirty (30) days before an event. Cancellations made with less than thirty (30) days before the scheduled event will result in no refund of the base rent.

RETURN OF KEYS: Lessee shall return the keys to the Liedertafel Hall no later than 5:00 p.m. the business day following the event. The keys may be brought to City Hall during regular business hours or placed in the drop box located on the west side of City Hall.

RENTAL HOURS: As a general rule, the hours of operation for the Liedertafel Hall are from 7:00 a.m. to 11 p.m., Sunday through Thursday, and until 12:00 midnight on Friday and Saturday.

RENTAL & DEPOSIT RATES: Rental and deposit rates shall be set by the City Council from time to time and shall be subject to change without notice. When there is a rate change, the old rate shall apply for everyone who has made a deposit before the date of the rate change.

DEPOSIT: The Lessee is responsible for removing all decorations and personal belongings prior to vacating the Liedertafel Hall at the contracted time. If Lessee returns the following day to remove items, the Lessee will be charged an additional rental fee. Upon inspection of the facility after rental, if any damages have been incurred or if the general housekeeping rules have not been followed, charges for cleaning services or reparation will be deducted from Lessee’s deposit. Any remaining balance will be billed to Lessee.

FIRE SECURITY: Regular exit doors, emergency doors, corridors, walkways and fire extinguishers shall not be blocked.

SECURITY: Security may be required at events held at the Liedertafel Hall at the discretion of the City. Factors involved in determining the requirements for Security include the size of the event, whether alcohol will be served, and length of the event. When security is required by the City, the Lessee shall employ a certified police officer(s) and compensate them directly. All security personnel must be approved by the Sealy Chief of Police. It is the responsibility of the Lessee to contact Sealy Police Department if certified officers are needed for the event and to confirm that arrangements for security have been made.

SET-UP & DECORATIONS: Tables, chairs and other equipment owned by the Liedertafel Hall are for exclusive use of the Lessee and shall not be sublet or removed from the facility for any reason. Decorations may be of any type or design as long as installation and placement does not damage the facility, interfere with emergency ingress or egress, or violate the fire code. Damages resulting for decorating will be borne by the Lessee.

ALCOHOL POLICY: The sale of alcoholic beverages shall not be permitted at the Liedertafel Hall.

COOKING: Cooking with grease, oil, propane, gas, or any open flame is prohibited within the facility. Equipment such as roasters or crockpots to keep food warm is allowed.

DANCES: Dances at the Liedertafel Hall shall be permitted as after-dinner entertainment during family functions and/or when sponsored by a not-for-profit organization. Dances as a profit-making venture shall not be allowed.

LIABILITY FOR LESSEE’S PROPERTY: Neither the City, nor its employees, shall be liable for any loss damage or injury to property of the Lessee.

OBSERVANCE OF LAWS AND REGULATIONS: The Lessee shall comply with all City, County, State and Federal laws, and with regulations pertaining to the Liedertafel Hall. Violations by the Lessee or its agents or employees may result in the cancellation of the rental agreement and/or discontinuation of the use of the facility.

OBJECTIONABLE CONDUCT: Any person at the Liedertafel Hall whose conduct is disorderly or disruptive may be ejected from the premises by the City’s designated representative or any peace officer. Disorderly or disruptive conduct may include, but not be limited to, the following:

  1. Intoxication,
  2. Use of abusive, indecent, profane or vulgar language,
  3. Making offensive gestures or displays,
  4. Abusing or threatening another person in an offensive manner,
  5. Making unreasonable loud noise,
  6. Fighting with another person,
  7. Vandalism, or
  8. Possession of firearms.

The Lessee for the event at which any such ejection occurs shall hold harmless, indemnify and defend the City, its officers, agents, and employees against any claim related to such ejection.

OBSTRUCTION OF ACCESS: No portions of the sidewalks, entries, passage ways, aisles, vestibules or other ways of access of the premises shall be permitted to be obstructed, nor shall any windows, ventilators or ventilating fixtures be obstructed.

ABANDONED EQUIPMENT OR ARTICLES: The City shall not be held responsible for property left on the premises. All property of the Lessee shall be removed by the end of the rental agreement period. The City assumes no responsibility for the losses of the property when such losses are caused by theft or disappearance.

WEAPONS: The Lessee will ensure that no one, other than qualified, uniformed security personnel and law enforcement personnel, brings firearms onto said leased premises, without special written permission from the City. The Lessee will ensure that no one brings knives, other than knives used for food preparation, knives used for food consumption, or pocket knives with blades no longer than three (3) inches, onto said premises without special written permission from the City.

ELECTRICAL INTEGRITY: The Lessee will not permit any person(s) to bypass a breaker box or modify any electrical outlet, light fixture, switch, or fan located on the leased premises.

TOSSED ITEMS: The Lessee will not permit any person(s) to throw, spread, or toss any items whatsoever inside the facility. The Lessee is permitted to toss birdseed only outside the facility.

TRASH: Lessee agrees to double bag all trash and debris left after its function and remove to provided receptacles.

INDEMNIFICATION: Lessee acknowledges that it will be responsible for the activities occurring on the leased premises during the period of its possession, and that it will permit no nuisance or illegal or immoral activity to take place thereon. Lessee further agrees that it will indemnify and hold harmless the City of Sealy, its officers, agents, or representatives from any claim for injury or death to any person(s) or damage to any property during the Lessee’s possession of the leased premises.
